These are the official rules (“Rules”) that govern your participation in the Chartnote promotion (“Contest”).
No Purchase Necessary. No purchase or payment of any money is necessary to participate in CONTEST. VOID WHERE PROHIBITED.
Sponsor. Sponsor of this promotion is StatNote, Inc. DBA Chartnote, 2020 5th St. #1472, Davis, California 95616. (“Sponsor”).
Contest Period. This Contest begins on March 1, 2022 at 00:01 United States Pacific Time and ends on May 31, 2022 at 23:59 United States Pacific Time (the "Contest Period"). Sponsor’s computer is the official time-keeping device. All entries must be submitted and received during the Contest Period. Odds of winning depend on the number and timing of entries submitted during the Contest Period.
How to Enter. To be eligible for a potential prize, participant must, during the Contest Period, create original snippets or encounters through the participant’s Chartnote web application account (“Chartnote App”) by following the instructions below. Each snippet or encounter created increases the participant's chance to win the Contest at the end of each month. Sponsor may offer alternative ways to earn points during the Contest. Poor quality of snippet or encounter content, plagiarism, fraudulent methods of entry or circumvention of the rules may result in the Sponsor invalidating your entries and removing them from the Contest at the Sponsor’s sole discretion.
Create a Snippet. Create a new original snippet on your personal library (My Library) and ensure that “share with Community” is enabled.
Create an Encounter. Create a new original encounter on your personal library (My Library) and ensure that “share with Community” is enabled.
Qualification. A participant may enter multiple times, but each individual participant is only eligible for one prize. Multiple participants are not permitted to share the same email or other account needed for participation. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, duplicating snippets, duplicating encounters, or any other methods will void that participant’s entries and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Each potential winner may be required to show proof of being the authorized account holder. Sponsor will have the right to determine the identity of the participant(s) and timing of entries in its sole discretion.
Prize. There will be nine (9) Contest winners at the end of each month (the Winners). The monthly winners will receive a cash prize of one hundred dollars ($100). There will be twenty-seven (27) Contest winners in total during the Contest Period. Total value of all prizes given is $2,700.
Prize (1) - Chartnoters of the Month. Top 3 three (3) participants with the most snippets created at the end of the calendar month. (1 snippet = 1 point).
Prize (2) - Snippets of the Month. Top 3 three (3) participants whose snippet has the most number of copies by other users in the community at the end of the calendar month. (1 snippet copy = 1 point).
Prize (3) - Encounters of the Month. Top 3 three (3) participants whose encounter has the most number of copies by other users in the community at the end of the calendar month. (1 encounter copy = 1 point).
Points. Points earned by participating in the Contest are not real money, do not have monetary value, and may never be redeemed for “real world” money, or other items of monetary value.
Determining Winners(s). Winners will be selected on the last day of each month until June 2022. For each prize, the top three (3) participants with the highest point count held at the end of the calendar month will be the Winners. Real-time count will be available online at https://chartnote.com/library/leaderboard. Participants’ points do not carry over month-to-month. Sponsor will notify Winner from Chartnote App account via direct/private message or via email address associated with the Winning Entry with instructions on how to redeem their prize within the time frame designated by Sponsor. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive account(s), technical difficulties associated therewith, or Winner’s failure to adequately monitor any account. Winner must then respond to Sponsor within five calendar days. Should a winner fail to respond to Sponsor, Sponsor reserves the right to disqualify that winner and select a new one. Winner may be required to sign an affidavit of eligibility, liability release, and a publicity release. By entering or accepting any prize, Winner allows Sponsor to use Winner’s name, photograph, likeness, voice, prize information, and biographical information for publicity and promotional purposes without further compensation where permitted by law. Except where prohibited, participation constitutes participant’s consent to Sponsor’s use of participant’s name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration.
Conditions of Participation. By participating, participant agrees to abide by these Rules and any decision Sponsor makes regarding this promotion (including awarding of any prize), which Sponsor shall make in its sole discretion. Sponsor reserves the right to disqualify and prosecute to the fullest extent permitted by law any participant or winner who, in Sponsor’s reasonable suspicion, tampers the entry or Contest process, intentionally submits more than one entry, violates these terms and conditions, or acts in an unsportsmanlike or disruptive manner.
Disqualification and Termination. Participants found engaging in any of the following activities may be disqualified and ineligible for any prize: (a) creating snippets or encounters with non-medical content or template content that would not be useful in a medical context; (b) duplicating snippets or encounters with no or minimal changes to increase point count; (c) plagiarism of snippet content from other users or external sources; (d) tampering with, disrupting, or attempting to disrupt, or any unauthorized use, misuse or abuse of any aspect of an entry or Contest; (e) violating any applicable law; (f) allowing any unauthorized person to use your email address or other account related to a Contest or entry; (g) attempting to perpetuate fraud on the Contest through multiple entries for the same Contest, false identification or email addresses, false registration, false impersonation or any other means; (h) failing to provide complete and accurate information required for payment of incentives and/or tax reporting purposes; or (i) for any other breach of these Rules. Termination for any of these reasons may also subject participant to civil and criminal penalties and may result in legal action. Sponsor may invalidate an Entry if the participant does not meet eligibility requirements.
Disclaimer, Release and Limit of Liability. SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY PRIZE OR YOUR PARTICIPATION IN THE CONTEST. BY PARTICIPATING IN THE CONTEST OR RECEIPT OF ANY PRIZE, EACH PARTICIPANT AGREES TO RELEASE AND HOLD HARMLESS SPONSOR AND THEIR RESPECTIVE SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS, ADVERTISING/PROMOTION AGENCIES, AND PRIZE SUPPLIERS, AND EACH OF THEIR RESPECTIVE PARENT COMPANIES AND EACH SUCH COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”) FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY, ARISING OUT OF PARTICIPATION IN THE CONTEST OR RECEIPT OR USE OR MISUSE OF ANY PRIZE. THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR: (A) ANY INCORRECT OR INACCURATE INFORMATION, WHETHER CAUSED BY PARTICIPANTS, PRINTING ERRORS OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR UTILIZED IN THE CONTEST; (B) TECHNICAL FAILURES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO MALFUNCTIONS, INTERRUPTIONS, OR DISCONNECTIONS IN PHONE LINES OR NETWORK HARDWARE OR SOFTWARE; (C) UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE CONTEST; (D) TECHNICAL OR HUMAN ERROR WHICH MAY OCCUR IN THE ADMINISTRATION OF THE CONTEST; OR (E) ANY INJURY OR DAMAGE TO PERSONS OR PROPERTY WHICH MAY BE CAUSED, DIRECTLY OR INDIRECTLY, IN WHOLE OR IN PART, FROM PARTICIPANT’S PARTICIPATION IN THE CONTEST OR RECEIPT OR USE OR MISUSE OF ANY PRIZE. If for any reason a participant’s Contest is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, participant’s sole remedy is another entry in the Contest, provided that if it is not possible to award another entry due to discontinuance of the Contest, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all participants up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, programming or any other reasons cause more than stated number of prizes as set forth in these Rules to be available and/or claimed Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims. Sponsor reserves the right to cancel, amend or suspend the Contest at any time, with or without prior notice, including if the Contest encounters any unexpected problems.
GOVERNING LAW AND DISPUTES. THESE RULES AND THE CONTEST ARE GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF CALIFORNIA AND THE UNITED STATES AND THE FORUM AND VENUE FOR ANY DISPUTE ARISING OUT OF OR RELATING TO THESE OFFICIAL RULES SHALL BE IN SAN FRANCISCO CITY AND COUNTY, CALIFORNIA. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN UTAH. Any such controversy or claim will be arbitrated on an individual basis, and will not be consolidated in any arbitration with any claim or controversy of any other party. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN CALIFORNIA UNITED STATES. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
